Effective October 1, 2024
House Bill 1147 was recently passed regarding the Playground Surfacing Materials requirement. This law (effective October 1, 2024) may impact open and prospective projects related to playground surfacing materials. Please reference the below documents:
This law prohibits the installation, supply, sale, solicitation, or offer for sale of playground surfacing materials that contain more than 90 parts per million (ppm) of lead, or a component that previously had PFAS chemicals intentionally added to it, after October 1, 2024. It also prohibits a county, municipality, or any unit of local government from adopting less stringent regulations related to playground surfacing materials containing lead or PFAS chemicals.
- If you have a playground surface-related project that is not yet under contract for installation (most likely FY25 projects as they'll be closer to the HB 1147's effective date of October 1, 2024), please complete one addendum per project and submit it with your completed application.
- If you have a current/open project with playground surfacing and it won't likely go to contract for purchase/installation until after October 1, 2024, please submit a complete addendum with the project number listed and I will add it to the open project file.
- If you are unsure of the project number I will add it to the form.
- If you have a current/open project with playground surfacing that has gone to contract/installed prior to October 1, 2024 there is nothing required at this time.
